Senior Resident Magistrate Zainabu Abdul ruled a life sentence for robbers who were captured on CCTV footage on June 25th, 2020 attacking a man in broad daylight at gunpoint along Rose Avenue in Kilimani.

According to CCTV footage that was captured in adjacent buildings and shared widely on social media attracting national attention, Paul Sewe Momanyi was accosted outside Almond Court as he headed to work at around 7 am, by two men who had leaped from a motorbike. 

One of them later identified as Humphrey Minyatta, (first accused) placed a knife on his throat as his accomplice Timothy Muzami (second accused) pointed a firearm on his forehead and snatched a bag that he was carrying. The first accused ransacked Momanyi’s pockets and took his mobile phone before they both jumped on the waiting motorbike leaving Momanyi heavily shaken after the 45 seconds ordeal.

Hon Zainabu went on to say that incidences of offenders utilizing boda bodas as getaway vehicles are on the increasing, necessitating the need to prohibit such behavior by giving the couple a life sentence.

The Directorate of Criminal Investigations expresses its gratitude to Hon. Zainabu for passing the punishment on the two criminals in such a short time.

We hope that the sentence serves as a measure of justice for Momanyi, who reported his life-threatening incident with the thugs to our police, prompting us to go on the hunt for them.

Detectives headquartered at DCI Kilimani jumped into action on a manhunt for the thugs as soon as they received the news, as the DCI Communication team issued a Twitter appeal, asking Kenyans with knowledge about the suspects to contact detectives.

The seasoned sleuths, led by then-Kilimani crime buster Fatuma Hadi, launched a covert intelligence-led operation that took them to the densely populated areas of Gatina, Kanungaka, and Kawangware, where they set up an ambush for the suspects for three days before expanding their dragnet to Pangani, where the two suspects were apprehended after a week.

Following his arrest, the first accused took the detectives to his home, where they recovered the suspect's knife, as well as the yellow-brown jacket and pair of shoes that he wore on the day of the attack, as shown on CCTV tape.

Momanyi positively identified the two as the ones who had attacked him during an identification parade. Momanyi's two phones and a laptop were recovered thanks to a third suspect who was also apprehended, albeit he could not be linked to the other two suspects.

The CCTV film was acquired by detectives from the Forensic Imaging and Acoustics section, who certified that it was legitimate and had not been tampered with after subjecting it to forensic examination. The guys' fate was determined by that conclusion.

Although the firearm used by the second accused has not been discovered, Senior Resident Magistrate Hon Zainabu Abdul, sitting in the Chief Magistrate's Court at the Milimani Law courts, emphasized in her decision that it is still out there being used to perform similar crimes on innocent Kenyans.

She went on to say that despite the fact that the accused were first-time offenders, they showed no remorse for their acts after inflicting the victim with tremendous mental suffering.

Hon Zainabu went on to say that incidences of offenders utilizing boda bodas as getaway vehicles are on the increasing, necessitating the need to prohibit such behavior by giving the couple a life sentence.

Zainabu stated that the incident gave them a wake-up call.

She also further added that the life sentence punishment was a motivation for the police.

"The sentencing also serves as a motivator for our policemen who put their lives on the line every day to ensure the public safety and security of all Kenyans". She concluded.
