This is after the court dismissed his new application for bail.

Eldoret High Court Judge Stephen Githinji in delivering a ruling on the application via a virtual court session said it lacked merit as there have been no substantial changes in circumstances since the previous bail application was dismissed.

Kinuthia has had two previous bail applications rejected and justice Githinji in his ruling said the accused might interfere with witnesses who are yet to testify if granted bail.

Out of the 21 prosecution witnesses, only 8 have so far testified against the accused facing murder charges for hacking Ivy Wangeci to death using an ax on April 9, 2021, as she was on her way to her hostel near Moi Teaching and Referral Hospital in Eldoret town.

The court also dismissed the bail application pointing out that the accused might be at risk if released following concerns from the family that the case was being handled at a slow pace.

“There has been no significant variant on the grounds that guided the previous denial of the bond to the accused,” noted Justice Githinji in part of his ruling delivered on September 23, 2021.

“Court recognizes the family and media have decried low pace of the case and accused might be at risk if released on bond. I find no merit for the application and it is hereby dismissed,” he added.

The hearing for the case continues on September 28, 2021.
