An Eldoret court has found a 40-year-old man guilty of defiling his neighbour’s eight-year-old daughter after a five-year legal battle.

The man, Anthony Keya, was sentenced to 30 years in prison for defiling a girl on December 8, 2016, in Wareng, Uasin Gishu County.

Senior Principal Magistrate Richard Odenyo, who handed down the punishment, remarked that the girl offered honest testimony on how the accused defiled her and evidence produced in court by the prosecution.

“Prosecution has been presented in this court with overwhelming and sufficient evidence to prove the guilt of the accused. I have no doubt that the accused defiled the minor. This court will sentence you to 30 years in prison,” ruled the Magistrate.

A medical report from Moi Teaching and Referral Hospital (MTRH), where the minor was treated since the incident had left her with a damaged hymen and significant genital injuries, confirmed that she was defiled.

The class two pupil was on her way to a neighboring shop when she encountered the accused, who summoned her to his home under the pretense of sending her to the shop.

The court was told that he suffocated the minor with a duster while repeatedly defiling her. After the encounter, the man offered her Sh 20 and urged her not to tell anyone. He further threatened to stab her with a knife if she told anyone about it.

The girl testified in court that a man who worked as a mason at a local building site in the neighborhood defiled her on multiple occasions.

She went home groaning in pain, later telling her mother about the event when she arrived home from work. The victim’s mother checked her; she found blood seeping from her private parts.

The village elder apprehended the suspect and handed him over to the Kiambaa police station, where he was kept until his arraignment in court.

He was released on a Sh 200,000 bond after denying the charge.

The case was prosecuted for more than five years, with several adjournments due to various technicalities from both the defence and prosecution sides.  The accused, a single father of two, has been granted 14 days to appeal.
