Court Dismisses Attempts by DJ Evolve To Withdraw Murder Case against MP Babu Owino

On Monday, Embakasi East MP Hon. Babu Owino received a major blow after the court rejected attempts by DJ Evolve to withdraw the murder case against him.

The Embakasi East legislator was charged with the attempted murder of Felix Orinda alias DJ Evolve in January last year after he was captured on a video shooting the Deejay.

However, on Monday, the court dismissed an application by DJ Evolve which sought to have all the charges raised against Babu Owino withdrawn.

In a ruling by Principal Magistrate Bernard Ochoi, the unconditional withdrawal application put forward by DJ Evolve was not appropriate in the case.

The magistrate also dared Babu Owino to come out in public and declare what he had given to DJ Evolve’s family to warrant a complete withdrawal of the case.

"This trial has not been told whether compensation was made despite the serious injuries suffered by DJ Evolve,” Magistrate Ochoi stated.

The court also noted the prosecution’s concern that DJ Evolve comes from a humble background and he may not be in a capacity to pay for the specialized treatment that he deserved.

"I agree with the prosecution that the same is not personal in nature and it can only be withdrawn by the DPP for good reason. For the above-stated reasons the application to withdraw this case under section 204 is dismissed," Ochoi stated.

Therefore the judge said it was in the public interest for the case to proceed to its logical conclusion.

MP Babu Owino is facing two counts, one of attempted murder and the other one for behaving disorderly while holding a firearm.
