The Deputy Speaker of the National Assembly Gladys Boss revealed the snippets of information regarding the loan contract that governed the construction of the multi-billion Standard Gauge Railway (SGR).

The legislature lightly perused through the contract that has since been made public via parliament and has discovered that there is a section entailing details on conflict resolution.

Appearing on Citizen TV on Monday, she noted that the excerpt shows that in the case of any conflict regarding the SGR, resolutions shall be held in Beijing, China and will fully apply Chinese law.

"I have just scanned through it and I haven't read it in great detail but as a lawyer, the first thing you check is that if there is a dispute where do you go to? And it has actually shown that the dispute will be resolved in Beijing, it will apply Chinese law and it's quite skewed against Kenya," she said.

The National Assembly Deputy Speaker further lauded the move to make the contract public which has been kept secret yet it should be in the public domain.

She noted that Kenyans will now have the opportunity of cross-examining the contract.

"I'm glad that it has been made public so that Kenyans can interrogate it, relook at it and be able to know that Kenya has a right to declare a dispute and have it re-written and it will also inform future agreements hence the reason why it is important to make agreements public," she said.

The proposal to make the contract public was made by Roads, Transport and Public Works Cabinet Secretary Kipchumba Murkomen to unveil the particulars of the pact which had been hemmed in concerns from the public on why former President Uhuru Kenyatta's administration remained coy about it and keep the deal under wraps.
