Supreme court to issue directive on BBI

 This is after the High Court and the Appeal court struck out the Bill, terming it illegal. A physical meeting will be held with all parties involved in the case on Tuesday during which direction on the hearing will be given. 

Attorney-General Kihara Kariuki, the Independent Electoral and Boundaries Commission, and the BBI secretariat appealed against the August 20 judgment which stopped the constitution review exercise, declaring it unconstitutional.In the verdict, the judges ruled that despite BBI being fashioned as a popular initiative, it was initiated by the president, essentially losing out on the popular initiative drive.

Attorney-General is challenging eight findings of the Appellate Court that overturned President Uhuru Kenyatta's bid to amend the constitution. Through Solicitor General Kennedy Ogeto, the AG is fighting the court's finding that the Basic Structure Doctrine is applicable in Kenya.

He is additionally challenging the ruling that civil proceedings can be instituted against the President during the tenure of office, in respect of anything done or not done, contrary to the Constitution.
