Police Ask Court To Detain Suspected Confirm Gang Leader For 30 Days

Nakuru police want to detain the alleged Confirm gang leader for 30 days, in order to complete their investigations.

Prior to filing charges against Dickson Macharia Waithera, aka Deco, police informed Principal Magistrate Isaac Orenge that they needed more time.

Lead investigator in the case, Police Inspector Japin Nyachae, testified in court that Macharia, who is alleged to be the leader of the group that has terrified Nakuru villagers for years, was likely to obstruct investigations if freed on bond.

“Given the nature of the offences, investigations could not be completed within 24 hours and I request the court to allow me to detain the suspects for 30 days to allow further investigations in regard to the phones and laptops,” Mr Nyachae said.

On Wednesday, Macharia was taken into custody from his home in the Kivumbini estate of the Nakuru Town East sub-county.

Security personnel reportedly recovered three phones, a laptop, and drugs worth more than Sh331,000 from the suspect, according to Peter Mwanzo, the commander of the Nakuru County Police.

Mwanzo said the suspect had a well-run drug trafficking organization in the Kivumbini neighborhood, where he is accused of hiring at least 200 young people to sell drugs.

The detective claimed that Macharia was responsible for a wave of criminal activity that had shaken Nakuru County.

His involvement in the gruesome killings of women, organized crime, such as drug trafficking and robberies, are among the matters the police are looking into.

Detectives also want to conduct forensic examinations on the laptops and cell phones taken from his home upon his detention.

Defense attorneys, however, objected to the proposal, claiming that such imprisonment would be unlawful and unconstitutional.

The suspect's attorney, Mr David Mongeri, pleaded with the court to reject the application because it lacked supporting documentary proof.

Mongeri asserted that his client was innocent and charged that the police had violated his right to freedom and a fair trial by improperly exploiting the legal system.

The court will issue its decision on Friday.
