A High Court in Eldoret town will in November make a ruling on a petition filed against 9 trustees of the Muslim Association Mosque Committee Eldoret.

The petition filed by the North Rift Youth Daawa Group General Secretary Jamal Diriwo Omari seeks to among others get court orders issuing a permanent injunction against the trustees over claims of misuse of association resources among others.

Diriwo filed the petition on May 31, 2021, under a certificate of urgency and also requested the court to issue an order appointing an independent auditor to audit the association’s assets since 1990 to date.

“When the report comes, we want it to be taken to the court so that we know the assets that the Muslim Association Mosque Committee Eldoret has had since 1990 and if they are still there or not,” noted the general secretary.

“As per my knowledge, the association has multi-billion properties within Eldoret town but they are now under the hands of a few individuals who are benefiting in the name of the Muslims,” he added.

Other orders sought include the appointment of a caretaker committee to manage all the association affairs as well as its reconstitution.

Respondents in the case had however filed an application opposing interim orders being sought by the petitioner.

In their submission, the respondents claimed they were not properly served by the petitioner and also want orders seeking them to be barred from holding their positions to be dismissed.

Ruling on the interim orders sought will now be issued on November 9, 2021, with Diriwo expressing optimism that the court will make a ruling based on facts on the table.

“We have faith in the rule of the law and believe the ruling will serve as an example on the manner in which association affairs should be handled,” he said.
